Terms of Service
These Terms of Service (“Terms”) govern your access to and use of Burger Blocker by Anthony Labs LLC (“Burger Blocker,” “the Service,” “we,” “us,” or “our”). By creating an account, accessing, or using the Service, you agree to these Terms.
If you do not agree to these Terms, do not use the Service.
1. What Burger Blocker Is (and Is Not)
Burger Blocker is a location-based habit-support app. You save restaurants and grocery stores you want to avoid, and the app uses geofencing to send you a call or text reminder when you arrive at or approach one of those places.
Burger Blocker is not:
- A medical, dietary, weight-loss, or health-treatment service
- An emergency service
- A monitoring, supervision, or safety service
- A guaranteed alert or message-delivery system
The Service is a supportive nudge, not professional advice. It does not replace guidance from a qualified doctor, dietitian, or other professional. Decisions about what you eat are always your own.
2. Eligibility
You must:
- Be at least 13 years old. If you are under 18 (or the age of majority where you live), you may use the Service only with the permission and involvement of a parent or legal guardian, who agrees to these Terms on your behalf and is responsible for any purchases.
- Use the Service only for lawful purposes
- Provide accurate account information
3. Account Responsibilities
You are responsible for:
- Providing accurate, complete, and current information
- Maintaining the security of your account and the phone number tied to it
- All activity that occurs under your account
You agree not to share account access with unauthorized users, impersonate anyone, or interfere with or disrupt the Service. We are not responsible for losses resulting from unauthorized access to your account.
4. Location and Permissions
Burger Blocker relies on device location, including background location, to function. By using the Service, you grant permission for the app to access your location to detect your saved places, as described in the Privacy Policy.
You may revoke location, notification, or other permissions at any time through your device settings. Doing so will limit or disable the Service’s core features, and we are not responsible for missed alerts that result.
5. Acceptable Use
You agree not to use the Service to:
- Violate any law, regulation, or carrier policy
- Harass, threaten, deceive, or defraud others
- Send spam or unsolicited bulk messages, or circumvent A2P/messaging regulations
- Track, monitor, or send alerts to anyone other than yourself without their knowledge and consent
- Reverse engineer, probe, or interfere with the Service or its providers
We reserve the right to suspend or terminate accounts for misuse, suspected abuse, or carrier complaints.
6. Calls, Texts, and Carrier Compliance
Burger Blocker makes commercially reasonable efforts to deliver the call and text alerts you configure. By using the Service, you acknowledge and agree that:
- Alert delivery is not guaranteed
- Calls and messages may be delayed, filtered, blocked, or dropped by wireless carriers or downstream providers
- Standard carrier message and data rates may apply
- Geofenced detection depends on your device, its settings, signal, and operating-system behavior, and may be late, early, or missed
- Carrier rules and enforcement practices may change without notice
We are not responsible for carrier actions, device behavior, outages, or detection failures beyond our reasonable control.
7. No Guaranteed Delivery or Outcomes
Burger Blocker does not guarantee alert delivery, timing, correct detection in all circumstances, or continuous availability. It is a behavioral aid, and we make no guarantee about health, dietary, or weight outcomes. Do not rely on the Service for any urgent, critical, or time-sensitive purpose.
8. Subscriptions and In-App Purchases
Burger Blocker may offer auto-renewable subscriptions that unlock paid features, sold as in-app purchases through the Apple App Store. By purchasing a subscription, you acknowledge and agree that:
- Subscriptions auto-renew at the end of each billing period unless canceled at least 24 hours before the period ends
- Billing is handled by Apple through your App Store account, and payment is charged upon confirmation of purchase
- You can manage or cancel anytime in your device Settings (Settings → your name → Subscriptions); canceling stops future renewals but does not retroactively refund the current period
- Refunds are subject to Apple’s refund policy and are handled by Apple, not by us
- Subscription prices may change, with notice provided in accordance with Apple’s App Store requirements
9. Service Availability and Changes
We may modify, add, or remove features; suspend the Service for maintenance; change pricing or usage limits; or discontinue the Service or parts of it. We are not liable for changes, interruptions, or discontinuation of the Service.
10. Termination
You may stop using the Service at any time. We may suspend or terminate access for violation of these Terms, suspected abuse or fraud, to comply with legal or carrier requirements, or to protect the Service or other users — potentially without prior notice.
11. Intellectual Property
The Service, including its software, branding, designs, and content, is owned by Anthony Labs LLC and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without written permission.
12. Disclaimer of Warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” BURGER BLOCKER DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- MERCHANTABILITY
- FITNESS FOR A PARTICULAR PURPOSE
- NON-INFRINGEMENT
- RELIABILITY OR AVAILABILITY
THE SERVICE IS NOT WARRANTED TO BE ERROR-FREE OR UNINTERRUPTED.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BURGER BLOCKER SHALL NOT BE LIABLE FOR:
- INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES
- LOST DATA, MISSED ALERTS, OR MISSED CALLS OR MESSAGES
- HEALTH, DIETARY, OR PERSONAL OUTCOMES
- RELIANCE ON THE SERVICE FOR ANY URGENT OR CRITICAL PURPOSE
TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
14. Indemnification
You agree to indemnify and hold harmless Anthony Labs LLC from any claims, damages, losses, or expenses arising from your use of the Service, your violation of these Terms, or your violation of applicable laws or third-party rights.
15. Privacy
Your use of the Service is also governed by the Burger Blocker Privacy Policy.
16. Governing Law
These Terms are governed by the laws of the State of Washington, without regard to conflict-of-law principles.
17. Changes to These Terms
We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
